§ 1
GENERAL PROVISIONS
- The Organiser of the 10th Energy Congress (“Conference”) is the Lower Silesian Institute for Energy Studies, based at ul. Januszowicka 5, 53-135 Wrocław, Poland, Tax ID No. 8992772111 (“DISE”).
- These Regulations, hereinafter referred to as the Regulations, set out the rules for providing conference services, the rules for using these services and the rules for processing of personal data in connection with organisation of the Congress.
- The Regulations are available free of charge at: https://dise.energy/kongres/en/regulations/ in a form that allows them to be downloaded, saved and printed.
- The official Conference website can be found at: https://dise.energy/kongres/en/ (“Conference Website”).
- For the purposes of the Regulations, the following definitions are adopted:
5.1 Participant – an individual who has applied for participation in the Conference or whose participation in the Conference has been applied for by the Registrant,
5.2 Registrant – a legal person, an individual running a business or an organisational unit without legal personality, who concludes an agreement with DISE on the principles set out in the Regulations,
5.3 Hotel – the entity hosting the Conference,
5.4 Registration – performing the action of registration for participation in the Conference according to the rules specified in the Regulations,
5.5 Organisers – DISE.
§ 2
PARTICIPATION IN THE CONFERENCE
- In order to participate in the Conference, it is necessary to send a completed electronic application form for participation via the website https://dise.org.pl/kongres/en/registration or to the address kongres@dise.energy, to receive a confirmation of registration on the list of participants from the Organiser, to pay the Conference fee and to submit a statement of acceptance of these Regulations.
- The number of places available for conference participants is limited. Applications will only be accepted until the pool of available places is used up.
- Upon registration, the Registrant:
3.1 accepts these Regulations,
3.2 declares that he/she is familiar with the documents containing the terms and conditions of participation in the Conference and accepts their content,
3.3 declares that he/she has received information on the processing of personal data by DISE in the scope necessary for the proper performance of the Service, which constitutes Annex 1 to the Regulations, and undertakes to provide this information to the Participants whose participation in the Conference he/she registers, declares that he/she agrees to document the meeting in a photographic and/or video form and to publish the above mentioned documentation, also the documentation including his/her image or his/her registered Participants whose consent he/she has, on the DISE website and in printed materials of DISE and its business partners,
3.4 consents to placing his/her data in the DISE database and to its processing for marketing purposes, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and the Act of 10 May 2018 on the protection of personal data. Provision of data is voluntary and the person providing the data has the right to inspect the data, as well as the possibility of correcting them.
3.5 consents to documenting the Conference in photographic and/or video form and to publishing the above documentation, also including his/her image.
3.6 consent to recording and dissemination of his/her image, together with the full name and professional functions.
3.7 consents to publishing and recording of materials related to the course of the Conference and making these materials available to third parties.
- Applications may be submitted until 21 September 2024.
- In the event that the Registrant refuses to accept the Regulations, the registration will not be completed and DISE will not be obliged to refund the fee, if any, and will not be held liable for any damages.
- DISE reserves the right to refuse to accept an application for participation in the Conference without giving any reason. In this is the case, DISE will return the Conference fee paid in full. Refusal to accept an application may not be made later than 4 days before the established date of the Conference.
- Any changes made by the Registrant regarding registration shall be made in writing (by registered letter to the address of DISE’s registered office) or to the e-mail address kongres@dise.energy, otherwise the changes shall be null and void.
- The Registrant is obliged to fill in the order (registration form) correctly and in accordance with the facts.
- DISE is not responsible for damages related to entering incorrect data of the Participant or Registrant in the order (application form).
§ 3
SUBJECT MATTER OF THE AGREEMENT
- Under the Agreement, DISE undertakes to enable the Participant to attend the Conference and the Registrant undertakes to pay a fee in respect thereof.
- DISE shall announce on the Conference Website the details of the subject, date, venue, programme and price of the Conference.
- The Organiser does not guarantee accommodation as part of the registration.
- The Organiser reserves the right to make changes to the conference programme.
- The Organiser reserves the right to change the speakers for reasons beyond its control. In such a case, the participant shall not be entitled to compensation from the Organiser.
§ 4
TERMS OF PAYMENT
- The Registrant is obliged to pay the conference fee within 14 days of receiving the pro forma invoice for participation in the Conference.
- Any bank charges will be borne by the Participant or Registrant.
- After payment, DISE will issue a VAT invoice to the address indicated in the order (online application form).
§ 5
RESIGNATION/CHANGE
OF PARTICIPANT/REGISTRANT
- Declaration of cancellation of participation in the Conference should be made in writing by sending it to the address of DISE or electronically to the e-mail address: kongres@dise.energy by 31 August 2024. Before this date, the Participant / Registrant shall be entitled to a refund of the fee paid, subject to the provisions of § 2.5. In the case of cancellation after this date, the Registrant shall be obliged to pay the full price in accordance with the concluded Agreement.
- The provisions of this chapter shall apply irrespective of the reason for cancellation of registration or non-participation.
§ 6
CONDITIONS FOR PARTICIPATION
AND CIVIL LIABILITY
- The condition for participation in the Conference is:
1.1. application for participation in the Conference according to the rules specified in the Regulations,
1.2. payment of the relevant fee in the amount and within the period specified in the Regulations,
1.3. the submission by the Registrant of a statement of having read and accepted the Regulations during on-line registration. In case of refusal to accept the Regulations, the registration will not be completed and the Organisers shall not be held liable for any damages on this account,
1.4. confirmation by the Participant of his/her presence on the day of the Conference, which is tantamount to accepting the Regulations by the Participant.
If any of the above conditions is not met, DISE may refuse the Participant entry to the Conference and will not be obliged to reimburse any costs incurred by the Participant or cover any damage suffered by the Participant on this account.
- Participants are obliged to comply with safety rules, health and safety regulations and fire safety regulations in force on the premises where the Conference is organised.
- The Participant and the Registrant are financially responsible for causing any damage during the Participant’s participation in the Conference. The Participant undertakes to cover all costs of repairing damages caused in the Hotel.
- DISE, the Hotel and any other owner of the venue where the Conference is held shall not be responsible for Participants’ belongings which may be lost, damaged or stolen during the Conference or Participant’s stay in connection with the Conference.
- DISE, the Hotel and any other owner of the venue where the Conference is held shall not be liable for any damage to the Participant arising during or in connection with the Conference and caused by force majeure or the actions of third parties including, in particular, other Participants.
- In the event of any damage to the Participant’s property, the Participant shall notify DISE immediately.
§ 7
CHANGE OF DATE AND CANCELLATION OF THE CONFERENCE
- DISE reserves the right to change the date of the Conference by notifying the new date no later than three weeks before the originally planned date of the Conference in the event of force majeure or other unforeseen random events beyond the control of DISE which make it impossible to hold the Conference at the original date. In such a situation, the Participant has the right to participate in the Conference on a new date, unless the Registrant withdraws from the Agreement within 14 days of receiving the information about the change of the Conference date.
- Fortuitous events are future, possible but uncertain events, in particular: flood, fire in the building(s) where the 10th Energy Congress is to be held or a failure threatening the life or health of the occupants of such building(s), street riots, natural disasters (in particular: earthquakes, hurricanes, floods and other extraordinary atmospheric phenomena, etc.), events threatening public order (in particular: acts of war, acts of sabotage, terrorist acts, strikes, demonstrations, etc.), epidemics (including epidemic threats), threats to the safety of the entire building(s), and events threatening the safety of the entire building(s).), events threatening public order (in particular: acts of war, acts of sabotage, acts of terrorism, strikes, demonstrations, etc.), epidemics (including threats of epidemics), acts of governmental authority (in particular: martial law, state of emergency, state of natural disaster, the prohibition of holding meetings, events such as conferences, fairs, etc.), other events whose occurrence prevents the organization of the Conference according to the program or threatens the life or health of Participants in the event of its holding.
- In case of withdrawal from the Agreement according to paragraph 1, the Registrant will receive a refund of 100% of the paid amount within 14 working days from the day of receiving by DISE the statement of withdrawal from the Agreement. The Organizer is not responsible for any further compensation claims of the Participant.
- In the event that the Conference is cancelled due to force majeure or for reasons of force majeure that prevent the Conference from taking place as well as its cancellation, the Participant or the Registrant shall not be entitled to any compensation or refund of any fees incurred in order to participate in the Conference. However, the Registrant is entitled to a refund of 100% of the amount paid.
- Information about the change of date of the Conference or its cancellation will be sent to the e-mail address provided in the form or will be communicated by DISE to the Registrant by telephone.
§ 8
FINAL PROVISIONS
- Any disputes that may arise from the conclusion of this Agreement shall be settled by the court with jurisdiction over the claimant’s registered office.
- The Polish text of the Regulations shall be binding for the settlement of any disputes.
- DISE reserves the right to modify the provisions of the Regulations at any time for important reasons. DISE will inform all Registrants of any change to the Regulations to the email address given in the registration form. In the case of non-acceptance of changes to the Regulations, the Registrant may withdraw from the Agreement within 14 days of receiving information about the change to the Regulations. Failure to withdraw from the Agreement shall mean acceptance of the new content of the Regulations.
- In matters not regulated by the Regulations and the online application form, the provisions of Polish law shall apply, including in particular the provisions of the Civil Code.
- The Regulations enter into force on 14.02.2024.
Appendix 1
Information on processing of personal data of the Registrant or persons representing him and of Participants
In accordance with Article 13(1) and Article 14(1) of the GDPR, we inform you that the controller of your personal data is the Lower Silesian Institute for Energy Studies with its registered office at ul. Januszowicka 5, 53-135 Wrocław, NIP 8992772111 (“DISE”).
In all matters relating to personal data, you can contact: kongres@dise.energy
DISE will process your personal data provided through online application forms and other forms of contact with DISE,
- in order to provide services related to the conduct of the Conference, including contacting the Registrant or Participant,
a) on the basis of Article 6(1)(b) of the GDPR in relation to the Registrant’s personal data,
b) on the basis of Article 6(1)(f) of the GDPR in relation to personal data of persons representing the Registrant or Participants,
- on the basis of Article 6(1)(f) of the GDPR in order to assert possible claims against the Registrant or Participant,
- on the basis of Article 6(1)(a) of the GDPR if additional consents have been given, to the extent and for the purposes indicated in the content of those consents,
- on the basis of Article 9(2)(a) of the GDPR if you give your consent to processing of personal data concerning your health to the extent and for the purpose indicated in the content of your consent.
If you have not provided your personal data yourself, the source of your personal data is the Conference Registrant.
Your personal data may be disclosed to: state authorities or other entities authorised on the basis of separate provisions, associates of DISE involved in the organisation of the Conference, banks in case of necessity to carry out settlements, other external entities supporting DISE e.g. in the area of IT, accounting or legal services, however such entities will process data on the basis of an agreement with DISE and only in accordance with its instructions.
Your personal data will be stored in the European Economic Area (EEA).
Your personal data will be processed until the execution of the Agreement (holding of the Conference) and also after its completion for purposes related to:
- the assertion of claims in connection with the performance of the Agreement (i.e. in principle for a maximum period of 6 years from the completion of the Agreement),
- to comply with legal obligations, including in particular tax and accounting obligations (i.e. generally for 5 years from the end of the calendar year in which the tax deadline expired),
- with your consent to processing of your personal data, until such time as you withdraw your consent,
- with your consent to processing of personal health data for a period of 14 days after the end of the Conference or until you withdraw the consent concerned.
You have the right of access to your data and the right to rectification, erasure, restriction of processing, the right to data portability, the right to object and, in the case of additional consent, the right to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.
If you consider that the processing of personal data concerning you violates the provisions of the GDPR, you have the right to lodge a complaint with the President of the Office for Personal Data Protection.
Providing personal data contained in the application form is voluntary; however, failure to provide data will prevent registration and participation in the Conference.
Your data will not be used for automated decision-making or subject to profiling.
Appendix 2
Contents of consents and declarations
- I declare that I have read and accept the Conference Regulations.
- I declare that I consent to the processing of my personal data by DISE to the extent necessary for the correct performance of the Service and I consent to transfering and entrusting of their processing to other entities for the purpose and to the extent necessary for the correct and proper performance of the Service.
- I consent to DISE processing my personal data for the purpose of marketing its own products and services after the termination of the Agreement and to receive commercial information from DISE electronically.
- I consent to placing my data in the database of the Lower Silesian Institute for Energy Studies and to its processing for marketing purposes, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and the Act of 10 May 2018 on the protection of personal data.
- I agree that the Conference may be documented in photographic and/or video format and that the above-mentioned documentation, including my image, may be published.
- I consent to recording and dissemination of images of participants and speakers of the Conference, including their names and professional functions.
- I consent to publishing and recording of materials related to the course of the Conference and making these materials available to third parties.
